These Terms of Service ("Terms") are an agreement between you and Brain Bout. They govern your use of the Brain Bout app and website. By creating an account or using Brain Bout, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Brain Bout.

1Who can use Brain Bout

You must be at least 13 years old to use Brain Bout. We ask for your date of birth when you sign up: anyone who enters an age under 13 is blocked from creating an account, and players aged 13-17 receive additional protections described in our Privacy Policy. If you are under the age of majority where you live, you may only use Brain Bout with the involvement of a parent or legal guardian, who agrees to these Terms on your behalf. We may refuse service, or close accounts, where these requirements are not met.

2Your account

You are responsible for keeping your login credentials secure and for activity that happens under your account. Provide accurate information when you sign up, and let us know promptly if you believe your account has been compromised. Choose a display name that does not impersonate others or violate these Terms.

3License to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Brain Bout on devices you own or control, for your own non-commercial entertainment. This is a license, not a sale — we and our licensors retain all rights in the app, its content, questions, branding, and software. You may not:

• Copy, modify, distribute, sell, or lease any part of the app.
• Reverse engineer or attempt to extract source code, except where the law permits.
• Use bots, scripts, or automated means to play, scrape questions, or manipulate matches, rankings, or XP.
• Circumvent, disable, or interfere with security or fair-play features.

If you access Brain Bout through the Apple App Store or Google Play, you also agree to the app store's applicable terms, which may add to these Terms.

4Fair play and acceptable use

Brain Bout is a competitive game, and it only works if everyone plays fair. You agree not to:

• Cheat, look up answers using automated tools, exploit bugs, or collude to rig matches or leaderboards.
• Harass, threaten, bully, or abuse other players.
• Post content that is hateful, sexually explicit, violent, illegal, or otherwise objectionable (see Section 5).
• Impersonate any person, or misrepresent your affiliation with anyone.
• Attempt to access accounts, servers, or data that are not yours.
• Disrupt or overload the service, or use it to break any law.

Practice opponents. Live Duel is designed to start quickly. If no other player is available when you start a match, you may be matched with a Brain Bout practice opponent so you can play right away. Practice opponents are not real accounts, do not represent other people, and matches against them do not appear in your match history. They are labelled as practice opponents in the app. You keep the XP you earn, and your skill rating is not affected by these matches.

Our Community Guidelines describe our standards for behavior and content in more detail and are part of these Terms.

5User content and license to us

Brain Bout lets you post content, including party chat messages and posts on category discussion boards ("User Content"). You keep ownership of your User Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate, moderate, and improve Brain Bout.

You are responsible for what you post, and you confirm you have the right to post it. We have zero tolerance for objectionable content and abusive behavior. We may review, filter, moderate, remove, or refuse any User Content, and we may act on reports, at our discretion and without notice, to keep the community safe.

6No payments (for now)

Brain Bout does not currently sell subscriptions or in-app purchases. If we add paid features in the future, we will provide separate purchase terms and update these Terms accordingly.

7Suspension and termination

You may stop using Brain Bout and delete your account at any time — see Account & Data Deletion. We may suspend or terminate your access, remove content, or reset ill-gotten stats if we reasonably believe you have violated these Terms, cheated, or created risk or harm for the community or the service. Where practical and appropriate, we will give notice, but serious violations may result in immediate action. Sections that by their nature should survive termination (such as licenses you granted us for existing content, disclaimers, and limitations of liability) will continue to apply.

8Disclaimer of warranties

Brain Bout is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that questions and answers are always accurate. You use Brain Bout at your own risk, to the fullest extent permitted by law.

9Limitation of liability

To the fullest extent permitted by law, Brain Bout and its makers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the app. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10Changes to the service and these Terms

Brain Bout is evolving, and features (including game modes) may change, launch, or be discontinued. We may update these Terms from time to time. When we make material changes, we will update the effective date and, where appropriate, notify you in the app. Continuing to use Brain Bout after changes take effect means you accept the updated Terms.

11Governing law

These Terms are governed by the laws of [GOVERNING LAW / JURISDICTION — TBD], without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.
